1. Acceptance of Terms
By accessing or using the website at towdeputy.com (or launchzonelabs.com) ("Site"), using our mobile applications, or engaging our services, you agree to be bound by these Terms of Service ("Terms"). The Site, apps, and services are operated by ALRW Software LLC, doing business as (DBA) Tow Deputy and Launch Zone Labs ("Tow Deputy", "Launch Zone Labs", "we", "us", or "our"). If you do not agree, please do not use our Site or Services.
2. Services
We provide an AI-powered receptionist and dispatch platform known as Tow Deputy, alongside custom software development, mobile app development, cloud architecture, and related technology solutions (collectively, the "Services"). The platform automates call answering, location and vehicle detail aggregation, tracking link generation, and towing dispatch logic.
3. Use of the Services & Location Tracking
You agree to use our Services only for lawful purposes.
- Location Aggregation: To facilitate accurate dispatching, the Services track and process geographic locations via web-based tracking links, mobile applications, and driver networks. You agree to allow Tow Deputy to collect and utilize this tracking data to perform the requested towing dispatch services.
- Prohibited Activities: You may not use the platform to transmit spam, malware, or fraudulent content; attempt unauthorized access to our systems; or scrape data from our interface without prior written consent.
4. Payment Processing, Subscriptions & Deposits
We utilize third-party payment gateways, including Stripe, to process software subscriptions, service fees, and towing deposits. By authorizing a payment, you agree to comply with the terms of our third-party payment processors.
- Software Subscriptions: All fees paid by towing companies for the use of the Tow Deputy AI platform and related Launch Zone Labs software subscriptions are strictly non-refundable.
- Towing Deposits: Deposits paid by end-customers to secure a tow are non-refundable. The sole exception to this policy is if a dispatched tow driver explicitly accepts and confirms the tow request, but entirely fails to arrive at the designated location.
- Chargebacks: Any unwarranted chargebacks will result in immediate suspension of access to the Services.
5. Intellectual Property & Data Ownership
All software code, AI greeting workflows, underlying machine learning logic, logos, graphics, and text on this Site are the exclusive property of ALRW Software LLC.
- Data Monetization & Commercial Rights: With the strict exception of mobile numbers and SMS consent data (which are governed by Section 12 and will never be sold or shared for marketing), ALRW Software LLC retains full, absolute ownership over all data processed through the Services. We reserve the explicit right to collect, use, transfer, and sell any user data, including names, email addresses, geographic locations, vehicle types, call transcripts, and dispatch logs, for any commercial purpose.
- AI Training License: We reserve the right to utilize voice recordings, textual inputs, and interaction data to train, evaluate, and scale our proprietary artificial intelligence models and automated speech recognition networks.
6. Platform Role & Real-World Liability
Tow Deputy is exclusively a communications and dispatch software platform. We do not provide towing, roadside assistance, or transportation services, nor do we employ tow truck drivers.
- Independent Actors: Tow drivers and towing companies utilizing our platform are independent third parties.
- No Physical Liability: ALRW Software LLC is not responsible for any actions, omissions, negligence, or misconduct of any tow truck driver, towing company, or end-customer. We explicitly disclaim all liability for any property damage, vehicular damage, personal injury, physical altercations, or financial disputes that occur during or as a result of the physical towing process. Any claims arising from the physical towing service must be directed at the towing company providing the service.
7. Disclaimer of Warranties
The Services and their content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the AI interactions will be completely error-free or free from operational "hallucinations" (including but not limited to incorrect pricing quotes or inaccurate ETAs generated by underlying language models).
8. Limitation of Liability
To the fullest extent permitted by law, ALRW Software LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages — including lost revenue, towing vehicle damages, or business interruption — arising out of the use or inability to use our platform or reliance on AI-generated instructions.
9. Indemnification
You agree to indemnify, defend, and hold harmless ALRW Software LLC, its officers, directors, and employees, from and against any claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to attorney's fees) arising from your use of the Services, your violation of these Terms, or your violation of any third-party right, including physical property damage, personal injury, or predatory towing claims.
10. Dispute Resolution & Binding Arbitration
Any dispute arising out of or relating to these Terms or the Services shall be resolved through binding arbitration, rather than in court. You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
11. Privacy
Your use of our Services is also governed by our Privacy Policy, which is hosted at towdeputy.com/privacy and incorporated into these Terms by reference.
12. SMS Communications (Tow Deputy Alerts)
Launch Zone Labs / Tow Deputy operates an automated SMS notification program under the name Tow Deputy Alerts. By verbally agreeing to receive text messages at the end of your AI phone call, or by otherwise opting in (such as through a signed service contract), you consent to receive SMS updates related to your specific towing service.
- Program Description: Tow Deputy provides automated SMS notifications to towing dispatch drivers and end-customers. Drivers receive updates regarding new bookings and location details. End-customers receive transactional updates regarding tow ETAs, pricing quotes, and deposit links.
- Message Frequency: Message frequency varies per user based on the number of active towing requests and necessary status updates.
- Pricing: Message and data rates may apply.
- Opt-Out Instructions: You can cancel the SMS service at any time. Just text STOP to the shortcode or phone number that messaged you. After you send the SMS message STOP, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time, and we will start sending SMS messages to you again.
- Help & Customer Support: If you are experiencing issues with the messaging program, you can reply with the keyword HELP for more assistance, or you can contact us directly at [email protected].
- Carrier Liability: Carriers are not liable for any delayed or undelivered messages.
13. Stripe Agreement
Payment processing services for all users on Tow Deputy are provided by Stripe and are subject to the Stripe Connected Account Agreement, which includes the Stripe Terms of Service (collectively, the “Stripe Services Agreement”). By agreeing to these terms or continuing to operate as a user on Tow Deputy, you agree to be bound by the Stripe Services Agreement, as the same might be modified by Stripe from time to time. As a condition of Tow Deputy enabling payment processing services through Stripe, you agree to provide Tow Deputy accurate and complete information about you and your business, and you authorize Tow Deputy to share it and transaction information related to your use of the payment processing services provided by Stripe.
14. Changes to These Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting to this page with an updated date. Your continued use of the Services after changes are posted constitutes your acceptance of the revised Terms.
15. Governing Law
These Terms, our platform operations, and any dispute arising from the use of our Services shall be governed by and construed exclusively in accordance with the laws of the State of Tennessee, without regard to its conflict of law provisions.
